Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Elaan — the notification infrastructure service offered at elaan.io, including its API, web console, SDKs and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms on behalf of yourself or the organization you represent ("you").

2. The Service

Elaan lets you send notifications to your own users across channels (email, push, in-app inbox) through one API: you define notification types and templates, register recipients, and trigger sends. We provide the Service with reasonable skill and care, but the Service is provided "as is" and we do not guarantee that it will be uninterrupted or error-free.

3. Accounts

You must provide accurate information when registering and keep your credentials (including API keys) confidential. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority where you live, to use the Service.

4. Acceptable use

You agree not to use the Service to:

• send spam or any messages to recipients who have not consented to receive them, or in violation of applicable law (including anti-spam and data-protection law);
• send unlawful, fraudulent, defamatory or malicious content, including phishing or malware;
• infringe others' rights, probe or disrupt the Service, or attempt to access other customers' data;
• resell the Service without our written consent.

We may suspend or terminate accounts that breach this section. You are responsible for complying with laws that apply to the messages you send and the recipients you send them to.

5. Your data

You retain all rights to the data you submit to the Service — your recipient lists, message content, templates and configuration ("Customer Data"). You grant us the rights needed to operate the Service (store, process and transmit Customer Data on your behalf). Our handling of personal data is described in the Privacy Policy. You are responsible for having a lawful basis to share your recipients' data with us.

6. Fees and payment

Paid plans are billed as subscriptions. Our checkout and billing are operated by Paddle (Paddle.com Market Ltd and its affiliates) as Merchant of Record — Paddle is the seller of record, handles payment, applicable taxes and invoicing, and Paddle's terms apply to purchases in addition to these Terms. Prices are shown at checkout; subscriptions renew automatically until cancelled. Cancellation and refunds are described in the Refund Policy. We may change prices with at least 30 days' notice, effective from your next billing period.

7. Free tier and changes to the Service

We may modify, add or remove features, and may set or change usage limits (including on the free tier), with reasonable notice where a change materially reduces the Service.

8. Intellectual property

The Service, including its software, design and documentation, is owned by Elaan and its licensors. These Terms grant you no rights in the Service other than the right to use it while these Terms are in force.

9. Liability

To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data; and (b) our total liability arising out of or related to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access for material breach of these Terms (including non-payment) or where required by law. On termination we will, on request made within 30 days, provide a reasonable means to export your Customer Data, after which we may delete it.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material we will give reasonable advance notice (for example by email or in the console). Continuing to use the Service after a change takes effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Finland, excluding its conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the Finnish courts, without limiting any mandatory consumer rights you may have.
